Australians Are Fighting Back Against 'Gender Identity' Captures of Policy and Law
Kirralie Smith must be free to talk about her sex
Australian police are pursuing criminal charges against a 51-year-old mother of six for referring to male sports cheat and lesbophobic YouTuber Riley J. Dennis as a man.
Kirralie Smith, named ‘Mother of the Year’ this May, has been charged with “villifying” Dennis and another Australian soccer player, who “were allegedly harassed online as part of Smith’s recent social media activity that targeted the inclusion of transgender athletes on the soccer field.”
“In two days’ time, there will be a separate mention for a case against me by another male athlete who is claiming I have vilified him for the same thing,” Smith told Parliament House in a speech Monday.
“In the space of just 5 weeks, I, as an adult human female, formerly known as a woman, will appear in four different court cases to defend women’s rights to say no to men in our spaces.”
Wounding the pride of men who cheat at women’s soccer, or their quisling ideological supporters, on social media is becoming literal “violence” in Australian courtrooms, if the new ‘world’s most marginalized community’ has its way.
“Correctly sexing a male is not vilification. Identifying males in female sporting teams is not violence, nor does it incite violence,” Smith told the Australian Parliament.
In contrast, Riley Dennis has reportedly injured multiple women on the soccer field with his big man-body, but he has not been charged with criminal battery of women. He instead enjoys the full protection of Australian sporting authorities to abuse his ‘identity’ claims and abuse women.
Riley Dennis has a special hatred for lesbians, but not the kind of hate that gets you cancelled, in Australia. None of the alphabetical human rights organizations that once stood up for the rights of same-sex attracted people in Australia will now stand up against a man who declares lesbians are “transphobic” and “genital fetishists” for excluding his penis.
Such men are the new sacred class, the priests of Pride.
Smith, who leads an organization called Binary Australia, represents the realignment of countercultural political forces in the face of the threat that the cultic mob pushing ‘gender identity’ activism on every aspect of life poses to families, women, and children.
Until 2018, Binary Australia was Marriage Alliance, an organization opposed to marriage equality. Smith herself was a New South Wales candidate for The Australian Liberty Alliance and the Australian Conservatives Party, which no longer exists.
Binary Australia has found a new mission — and new allies — “to push back against harmful gender theory and the aggressive ideological agenda that comes with it.”
This is what the New South Wales (NSW) police mean by “violence, harassment, intimidation, or stalking” of poor innocent Riley Dennis. Any verbal pushback is literal hate and violence. Words of opposition cause physical harm, just like black magic. Kirralie Smith is effectively on trial for witchcraft.
"The police, media, politicians, and organizations such as the Australian Sports Commission are all acting to protect males who appropriate female stereotypes over and above actual women," Smith told Parliament.
At the core of the problem is the 2013 amendment to the Sex Discrimination Act (SDA) of Australia which allowed for the substitution of ‘gender identity’ for sex in law and policy. No public vote was ever held.
“So, was due diligence done?” Sall Grover asked Parliament, calling on them to repeal the 2013 amendment. “If it was, and these very obvious realities were ignored, but gender identity was still put into the Sex Discrimination Act, was it done in malice?”
“If due diligence was not done, but gender identity still put into the SDA, it’s gross incompetence,” Grover said. “This can’t possibly have been done for equality or fairness, because what is equal or fair in forcing citizens to believe a lie and erasing the legal class of 50% of the population?”
Grover is currently crowdfunding AUS $1 million to take her case to the Australian High Court after a man filed a complaint against her app, Giggle, for excluding men who ‘identify’ as women.
"My own twin daughters were only days old when the reality of biological sex was legislated away in this very parliament house,” attorney Katherine Deves told Parliament Monday. Deves is Grover’s counsel in Tickle v Giggle.
“Their right to be recognised as biological females, as a distinct sex class in law, is abrogated by the demand of biological males who wish to identify into that sex class," Deves said.
As Deves explained to The Distance last week, the original 1984 Australian Sex Discrimination Act was based on the 1979 UN Convention on the Elimination of All Forms of Discrimination against Women (CEDAW), which does not mention ‘trans’ or ‘gender identity.’
Grover contends that the 2013 amendment is incompatible with CEDAW and therefore unenforceable. Victory in this litigation would go a long way to reestablishing rights for women in Australia above the rights of men who demand to be called ‘women.’
It is an uphill fight. “Very few politicians in this building have an appetite for truth,” Smith said Monday. “They and those who have come before them have legislated lies into law. No one can change their sex.”
“The government appears to be afraid of the truth. In turn the media and the courts act as if they are afraid of the truth,” Smith said. Making them fear truth was key to the whole project of capturing Australia for ‘gender identity.’
“Upending our understanding of biological sex and redefining the most basic conceptual experience of human existence – whether one is male or female – is being done without the mandate of the people,” Deves recently wrote about legislation in NSW to further enshrine ‘gender identity’ in state law.
Australia had a plebiscite on same-sex marriages, so why not one for redefining ‘sex’, ‘man’, and ‘woman’? Do our legislatures honestly believe that biological sex is a self-perception or a declaration, rather than an objective observation based on a person’s immutable male or female physiology? Metro-dwelling rainbow activists in Greenwich’s electorate may think it is, but the vast majority of ordinary Australians living ordinary lives in the suburbs, rural, and regional areas surely do not.
Canberra, the capitol of Australia, lies in NSW, which is the most populous state of the country. Not surprisingly, NSW is a hotbed of ‘gender identity’ activism, but there is really no safe place in Australia for any critic of ‘gender identity’ right now.
Labor currently hold a majority in Parliament. The Liberal Party is the major party alternative on the center-left. Labor governments in Victoria and Western Australia have taken children away from parents who failed to ‘affirm’ transgender ‘identities,’ for example, but Queensland and Tasmania, the states with Liberal governments, also have some of the most oppressive ‘pro-affirmation’ laws in Australia. Tasmanian courts outright deny lesbians any right to have boundaries with men.
In Australia as everywhere else, ‘gender identity’ enjoys a pernicious ideological grip over the local Green Party. Linda Gale, a resident of Victoria, was elected as a party officer last year, but then her election was overturned when her views on gender identity were deemed ‘toxic.’
The so-called ‘Teal independents’ are in fact suburbanites who favor an ideology of climate alarmism and LGBTQAlphabetical affirmation.
With no safe political harbor — no political party naturally willing to hear them — anywhere from center to left, critics of ‘gender identity’ in law and policy look to the right, and find only the National Party of Australia, also known as the Nationals or the Nats.
Recognizably rural, the Nats have declined nationwide as farming and the outback economy have diminished, but they also absorbed the Liberal Party in Queensland state, suggesting further realignments are possible.
Having embraced ‘antiwoke’ ideas, the Nats are also framed as extremists in mainstream Australian media. Advocates for women and children on the left, right, and center are similarly framed as “anti-trans campaigners.”
The depth of media regulation capture can be seen in the appointment of Julie Inman Grant, an American and a former Twitter ‘safety’ officer, as head of the Australian eSafety Commission.
As part of the global effort to convince Elon Musk to restore government-directed censorship to the platform, Grant recently demanded answers from Musk about a supposed surge of “hate” on Twitter/X.
Specifically, Grant cited “Indigenous Australians, disabled people and those who identify as LGBTQ+” who “experience online hate at double the rate of other Australians.”
Musk has restored too many user accounts that had been suspended for gender identity-related wrongthink, Grant alleges. (Full disclosure: this writer’s account was suspended 448 days for offering a sacred genderpriest of Scotland $1 million for a transgender gerbil.)
“A third of all reports into our office of online hate are coming from Twitter. It’s been a huge surge since October ’22 when Elon Musk took over,” Inman Grant told the Australian Broadcasting Corp, making the conceptual leap from words to violence.
“Twitter has always been fiery in terms of discourse, but it’s turned into an absolute bin fire,” by which Grant of course means that TERFs are not being silenced when they wrongspeak.
Shutting up women who complain about the idiocies of ‘gender identity’ has clearly become a closely-held value among Australia’s urban political elites. Kirralie Smith requires police intervention against her free expression. Sall Grover must be punished with a million-dollar litigation process for her free association. They have to be silenced, for if they can be heard, they will win.
This is the new priority of the so-called ‘human rights’ and ‘public safety’ bureaucrats in Australia: burn the witches who refuse to be quiet about the new genderpriests.
Political people who complain that critics of ‘gender identity’ have a ‘right wing’ agenda are making their own prophecy come true by enforcing their ridiculous blasphemy codes in the name of human rights and harm prevention. If Australian politics take a rightward turn, that will be entirely the fault of center-left politicians who refused to hear the women who gave them good warning.
